Terms of Use of the fortistechnology.pl platform

§1. General provisions

1. These Terms and Conditions set out the rules for using the online platform available at https://fortistechnology.pl (the “Platform”), owned by:

2. The Platform is intended in particular to present Fortis Technology’s business, information about products, services, technological solutions, production capabilities, and to enable contact with Fortis Technology.
3. The Platform may contain information regarding Fortis Technology’s offering, including products, services, projects, technologies, informational materials, and contact or inquiry forms.
4. The information provided on the Platform does not constitute an offer within the meaning of the Civil Code, unless expressly stated otherwise. It constitutes an invitation to contact, submit an inquiry, or begin commercial discussions.
5. A Platform User is any person using the Platform, in particular visiting the website, browsing its content, sending an inquiry via a form, or contacting Fortis Technology using the contact details available on the Platform.
6. Use of the Platform means acceptance of these Terms and Conditions with regard to the technical and organizational rules for using the Platform.
7. The User is obliged to use the Platform in accordance with applicable law, principles of social conduct, good practice, fair business practices, and the provisions of these Terms and Conditions.
8. The User is prohibited from providing unlawful content or content that infringes third-party rights, good practice, intellectual property rights, or the security of the Platform.

§2. Technical requirements

1. To use the Platform, the following are required:
   • a device with Internet access,
   • a current web browser, in particular Google Chrome, Mozilla Firefox, Safari, Microsoft Edge, or another browser compliant with modern web standards,
   • JavaScript enabled,
   • cookies enabled to the extent necessary for the proper operation of the Platform,
   • minimum recommended screen resolution of 1024 × 768 px.
2. Fortis Technology does not guarantee the proper operation of the Platform on outdated, unsupported, modified, or non-compliant browsers that do not meet current security standards.
3. Use of certain Platform features, such as contact forms, may require providing data marked as mandatory.
4. Use of the Platform may involve storing cookies or similar technologies on the User's device, in accordance with the rules described in the Privacy Policy.

§3. Services provided electronically

1. Through the Platform, Fortis Technology may provide electronic services free of charge, in particular:
   • making informational content available on the Platform,
   • enabling browsing of information about Fortis Technology's products, services, and business activities,
   • enabling contact with Fortis Technology via a contact or inquiry form, if available,
   • enabling submission of a quotation request,
   • enabling download of or access to informational materials, if available on the Platform.
2. The agreement for the service consisting of making the Platform content available is concluded when the User starts using the Platform and is terminated when the User leaves the Platform.
3. The agreement for the service consisting of handling the contact or inquiry form is concluded when the User starts using the form and is terminated when the message is sent or use of the form is discontinued.
4. Services provided electronically are free of charge unless expressly stated otherwise on the Platform.
5. Fortis Technology may temporarily restrict access to the Platform or its functions in the event of technical work, modernization, updates, failures, security threats, or other reasons beyond Fortis Technology's control.

§4. Contact forms and quotation requests

1. The Platform may allow sending a message, quotation request, or other inquiry to Fortis Technology via a contact form or the contact details provided on the Platform.
2. To send a message, the User may be asked to provide the data necessary to handle the inquiry, in particular first and last name, company name, email address, phone number, and message content.
3. The User is obliged to provide true, up-to-date data that does not infringe the rights of third parties.
4. Submitting an inquiry via the contact form does not constitute the conclusion of a sales agreement, a service agreement, or acceptance of an offer by Fortis Technology.
5. Fortis Technology's response to the User's inquiry may constitute commercial information, an invitation to negotiate, a quotation response, or an offer within the meaning of the Civil Code only if this clearly follows from its content.
6. Fortis Technology reserves the right to leave unanswered messages that:
   • contain unlawful, offensive content, content infringing third-party rights, or content contrary to accepted standards of decency,
   • constitute spam, an automated submission, or abuse,
   • contain false, incomplete, or incomprehensible data,
   • are unrelated to Fortis Technology's business.

§5. Rules for Using the Platform

1. The User is required to use the Platform in accordance with its intended purpose.
2. The User may not take any actions that could disrupt the operation of the Platform, compromise its security, or hinder other Users from using the Platform.
3. In particular, the following are prohibited:
   • providing or transmitting unlawful, harmful, offensive content, content infringing third-party rights, or content contrary to accepted standards of decency,
   • attempting unauthorized access to the Platform, server, databases, or Fortis Technology systems,
   • attempting to circumvent the Platform's technical security measures,
   • introducing malware, scripts, bots, or other automated mechanisms into the Platform,
   • engaging in activities that may overload the Platform,
   • copying, downloading, distributing, or using Platform content in a manner that infringes the rights of Fortis Technology or third parties,
   • using the Platform to send spam, unsolicited commercial information, or marketing content without the recipient's consent.
4. Fortis Technology may take technical or legal action in the event of a breach of the Terms, applicable law, or the Platform's security.

§6. Copyright and Intellectual Property

1. All materials posted on the Platform, in particular texts, photos, graphics, product descriptions, trademarks, logos, graphic layout, interface elements, informational materials, documents, files, and other content, are the property of Fortis Technology or are used by Fortis Technology under the relevant licenses, consents, or legal provisions.
2. Use of the Platform does not transfer to the User any intellectual property rights to the content available on the Platform.
3. It is prohibited to copy, distribute, modify, publish, transmit, reproduce, commercially use, or otherwise use materials available on the Platform without the prior consent of Fortis Technology, unless mandatory provisions of law provide otherwise.
4. The User may use the content available on the Platform solely for personal use, to the extent resulting from proper use of the Platform.

§7. Liability

1. Fortis Technology makes every effort to ensure that the information presented on the Platform is current, reliable, and complete; however, it does not guarantee that all information is at all times free from errors, omissions, or outdated content.
2. Information about products, services, technical parameters, availability, applications, photos, visualizations, or completed projects is for informational purposes only, unless expressly stated otherwise.
3. Fortis Technology shall not be liable for decisions made by the User solely on the basis of information posted on the Platform, without prior contact with Fortis Technology and confirmation of the current terms of cooperation, parameters, availability, or feasibility of performance.
4. Fortis Technology shall not be liable for disruptions to the operation of the Platform resulting from:
   • force majeure,
   • failures of hardware, software, networks, or telecommunications connections on the User's side,
   • acts or omissions of telecommunications, hosting, infrastructure service providers, or other third parties,
   • actions of third parties, in particular attacks on the Platform, attempts at unauthorized access, or activities compromising security,
   • use of the Platform by the User in a manner inconsistent with the Terms and Conditions, applicable law, or security rules.
5. Fortis Technology reserves the right to temporarily disable the Platform or part of it in order to carry out technical works, upgrades, updates, failure removal, or ensure security.

§8. Complaints regarding the operation of the Platform

1. The User may submit a complaint regarding the operation of the Platform or services provided electronically:

   • in writing to: Fortis Technology Rydzińska Sp. k., ul. Cisowa 9, 64-320 Niepruszewo,
   • by phone at: +48 61 820 94 29.
2. In the complaint, it is recommended to provide:
   • the User's contact details,
   • a description of the irregularity,
   • the date and time the problem occurred,
   • the address of the subpage concerned, if applicable,
   • the preferred method of follow-up contact.
3. Fortis Technology will respond to the complaint within 14 days from the date of its receipt, to the User's email address or in another manner indicated in the submission.
4. If processing the complaint requires additional information, Fortis Technology may ask the User to provide it.

§9. Personal data protection and cookies

1. The rules for processing the personal data of Platform Users are set out in the Privacy Policy available on the Platform.
2. The rules for the use of cookies and similar technologies are set out in the Privacy Policy or a separate cookie notice available on the Platform.

§10. Changes to the Terms and Conditions

1. Fortis Technology reserves the right to amend the Terms and Conditions for important reasons, in particular:
   • changes in legal regulations,
   • changes to the Platform's functionality,
   • changes to Fortis Technology's identification or contact details,
   • changes to the technologies used in the Platform,
   • the need to clarify the rules for using the Platform,
   • the need to improve the Platform's security.
2. The current version of the Terms and Conditions is published on the Platform.
3. Changes to the Terms and Conditions shall apply from the date indicated in its content or from the date the new version of the Terms and Conditions is published on the Platform.
4. Using the Platform after the changes take effect means acceptance of the current version of the Terms and Conditions.

§11. Final Provisions

1. In matters not regulated by the Terms and Conditions, the provisions of Polish law shall apply.
2. The Terms and Conditions are available on the Platform in a form that allows them to be saved, reproduced, and printed.
3. The Terms and Conditions enter into force on the date of publication on the Platform.
